
If you end up taking someone to small claims court or even civil court regarding a past due bill, if you win a judgment, there may be a new bill that can give you more leverage than you already have to get your money.
Jordan Ulery, a Republican state representative from Hudson NH says, "Withold their license." He explains by saying, "A license is not a right. They are privileges granted by the state, and if they aren't responsible enough to obey a court judgement, then they don't deserve the privilege of a license."
So if you are a business owner and are trying to collect from your delinquent customers, after winning a court judgment, you may end up having more recourses than filing a lien against property, attaching a bank account or wages, or paying a sheriff to seize the assets they owe you for. All of these things are time consuming and frustrating.
Under Ulery's bill all a business owner would have to do is file a request with the state not to renew any license issued by the state until is is proven or shown that the judgment has been satisfied. The state would then be reimbursed out of the judgement for its expenses in acting, in effect, as the collector or the collection agency.
